A probate-related property should not be approached like an ordinary listing where the owner simply decides one morning to put the house on the market.

We first identify who is handling the estate, what authority has been established, what the attorney has advised, who else needs to be involved and what is happening with the property itself.

The estate process may take time. The house does not stop existing while everyone waits.

Property expenses, maintenance and physical condition can continue changing while legal questions are being resolved. That is why understanding the real estate situation early can still be useful even when the property is not ready to be listed yet.

Carrying Costs

Mortgage payments, taxes, insurance, utilities, landscaping, snow removal, maintenance and security may continue while the estate is being handled.

Property Condition

Deferred maintenance can become more expensive when a property sits unattended. We identify obvious real estate issues early so the estate can make informed decisions.

Personal Belongings

Can we list the property immediately?

That depends on the estate circumstances and who has legal authority to act. Those questions should be confirmed with the attorney handling the estate. I can begin reviewing the property's condition, likely market value and preparation needs while those legal questions are being addressed.

Who is allowed to make decisions about the house?

That is a legal question that depends on the estate and the authority that has been established. The estate attorney should confirm who is authorized to act.

Should we clean everything out before calling you?

No. I would rather see the property before the family spends significant money or removes things that may affect the preparation plan. We can determine what actually needs to happen.

Should the estate renovate the property before selling?

Not automatically. We should first compare the property's current condition, likely buyer, estimated value and the potential benefit of any proposed improvements.

What if family members disagree about selling?

I can provide real estate information about value, condition, costs and market options. Disputes concerning legal rights, ownership or authority should be handled by the estate's attorney.

Can you work directly with our attorney?

Yes. With the appropriate authorization, the real estate side of the transaction can be coordinated with the estate attorney and other professionals involved.

Can you tell us what each heir will receive?

I can help estimate property value, anticipated real estate costs and potential transaction proceeds. Distribution of estate assets, individual entitlements and tax consequences belong with the attorney, CPA or other appropriate professional.

What if we live outside Massachusetts?

Much of the real estate planning can begin remotely. We can review the property, coordinate local needs and determine what requires someone's physical presence.
